Webslides: The "Systemic Discrimination" Revolution: Confronting the Rising Number of Class-Based OFCCP and EEOC Claims

Transcript

Presented by the ACC Employment and Labor Law Committee, sponsored by Jackson Lewis LLP

The OFCCP's statisticians and PhD-level testing exports have helped the Agency obtain over $100 million in back pay in the past two years. Borrowing a page from the OFCCP, the EEOC implemented a Systemic Discrimination initiative in 2006 that is beginning to have a profound impact on employers across the country. However, many employers, unaware of these important changes, continue to defend OFCCP audits and EEOC charges by focusing primarily on technical compliance and single claimant issues. The result has been a big jump in EEOC and OFFCP class-based claims and record-setting monetary settlements.

This interactive webcast will explain the systemic discrimination enforcement strategies of both the OFCCP and EEOC and provide attendees with practical approaches to proactively avoid adverse findings when under audit or investigation by the agencies.
