Employers historically have prevailed in more than 95% of all ADA lawsuits. This will change January 1, 2009. Is your company ready? In enacting the ADAAA, Congress expressly overturns several landmark ADA Supreme Court decisions and directs courts to interpret the term “disability” very broadly. It will make disposing of ADA cases prior to trial more challenging. By clarifying its intent concerning the interpretation of those definitions, and overturning several Supreme Court holdings, Congress significantly alters the scope of the ADA’s protection. Employers and Corporate Counsel should prepare to defend their judgment on issues including the scope and meaning of reasonable accommodation and undue hardship; essential job functions; whether performance or conduct standards are "job-related and consistent with business necessity"; that workplace risks satisfy the ADA's "direct threat" standard; and they have sufficiently explored "reassignment" as a reasonable accommodation.
