Presented by ACC’s Litigation and Employment & Labor Law Committees, and Saul Ewing, LLP The program will begin with a “mock TRO hearing” in which a corporation seeks to enforce a non-compete agreement executed by its former in-house counsel. The “hearing” will be based on a fact pattern touching upon issues such as the ethical implications of in-house lawyer non-compete agreements, trade secrets, the federal Computer Fraud & Abuse Act, and it will provide attendees with innovative and effective litigation strategies for both the enforcement of, and defense against, non-compete agreements. Although the fact pattern is based upon an in-house non-compete, the issues apply with equal force to employee non-compete agreements. In this regard, the program will help attorneys whose client companies (a) have employees in multiple states, and/or (b) find themselves on both sides of the issue because their companies both lose and hire employees to and from their competitors.
