Tort reform initiatives have received increased attention and publicity in recent years. Although there have been some modest successes, many major tort reform proposals have been defeated or delayed by the organized plaintiffs’ bar. As a result, high stakes mass and toxic tort lawsuits – involving, for example, pharmaceuticals like Vioxx, environmental contaminants like lead paint, mold, PCBs or MTBE, or industrial and consumer products containing asbestos or other toxins – remain as much of a problem for defendants as ever. And recent suits involving benzene illustrate the plaintiffs’ bar unceasing attempts to transform an established toxic tort into the next big mass tort or to find the next big thing in toxic torts. Join us as we provide insight into the anatomy of a mass tort, using benzene as an example. We will provide practical advice and pointers for corporate counsel that find themselves embroiled in the “next big one,” as well as helpful insights on how to avoid such litigation, or, at the very least, minimize your company’s exposure when the trial lawyers focus on your company or industry.
